ASSUMPTION OF RISK, RELEASE, AND WAIVER OF LIABILITY RELATING TO CORONAVIRUS/COVID-19
Generation Hope (GH) requires a signed Agreement from each Scholar to participate in GH meetings/events. By clicking 'agree' below, I attest that I have reviewed and agree to the provisions identified within. I agree to comply with all local, state, and federal orders and recommendations regarding preventing the spread of COVID-19 and all GH’s safety protocols regarding participation in activities.
I understand that:
● Novel coronavirus (‘‘COVID-19”) infections have been confirmed throughout the United States, including multiple cases in my area.
● COVID-19 is an extremely contagious virus that spreads easily, including through person-to-person contact.
● Using Generation Hope’s facilities, or participation in our activities/events (e.g., trainings, social events, etc.), may present the risk of contracting COVID-19. While GH takes safety and preventative precautions, GH can in no way warrant that COVID-19 infection will not occur through the use of such facilities or services or participation in GH activities/events.
● When participating in any Generation Hope event, I will follow the GH and CDC COVID19 guidelines.
Proof of Vaccination for Generation Hope Events
I agree to show proof of vaccination to Generation Hope management to participate in optional Generation Hope meetings and events.
I agree that if it is determined that I or my child(ren) have been in close contact with a person who has tested positive for COVID-19, that we will not visit or utilize GH’s office or attend meetings/events in-person and quarantine for 14 days after. Including any of the following:
● returning from highly-impacted areas subject to a CDC Level 3 Travel Health Notice, I agree that if it is determined that I or my child(ren) have been in close contact with a person who has tested positive for COVID-19, that we will not visit or utilize GH’s office or attend meetings/events in-person and quarantine for 14 days after. Including any of the following:
● returning from any area subject to a travel advisory by my local, state, or federal health department,
● exposure to any person returning from areas subject to a CDC Level 3 Travel Health Notice or local, state, or federal health department travel advisory, or
● exposure to any person who has a suspected or confirmed case of COVID-19.
● we ask that you notify us if you have attended an event or participated in in-person programming and later tested positive for COVID-19.
I further acknowledge that social distancing of 6 feet per person, and compliance with guidance and recommendations of public health agencies, may not always be possible. I fully understand the known and potential dangers to myself and/or my child(ren) of participating and/or attending optional in-person meetings/events and acknowledge that, despite prudent and reasonable efforts to mitigate such risks, I or my child(ren) may be exposed to COVID-19, which could result in quarantine requirements, serious illness, disability, and/or death.
Waiver of Liability
In further consideration of being permitted to participate in optional in-person meetings/events, I hereby agree to the following:
●I am aware that by signing this agreement, I am giving up the right to recover damages from Generation Hope in case of illness, injury, death, or property loss or damage, including for the avoidance of doubt and without limitation, exposure to COVID-19 at any Generation Hope sponsored meeting/event during my or my child(ren)'s participation and any illness, injury or death resulting as a result of my or my child(ren)'s involvement or attendance.
● I hereby irrevocably and unconditionally release, waive and discharge Generation Hope and any of its affiliates, and any of their respective directors, officers, employees, volunteers, and agents (collectively, the “Releasees”), from any and all actions, claims, and demands that I, my assignees, heirs, distributees, guardians, next of kin, spouse and/or legal representatives now have or may have in the future, whether known or unknown, foreseen or unforeseen, for injury, death or property damage, related to (i) my or my child(ren)'s participation in the meetings/events, (ii) the negligence or other acts, whether directly connected to these activities or not, and however caused, by any Releasee, or (iii) the condition of the premises.
● I further expressly agree that the foregoing assumption of risk, release, and waiver of liability and covenant not to sue is intended to be as broad and inclusive as is permitted by law, and that if any portion thereof is held invalid, the balance shall, notwithstanding, continue in full legal force and effect.
● I have carefully read and voluntarily signed this assumption of risk, release, and waiver of liability relating to Coronavirus/COVID-19 and further agree that no oral representations, statements, or inducement are apart from this written agreement.
By selecting 'I Agree', you acknowledge that Generation Hope (GH) has taken reasonable and appropriate steps to implement health and safety protocols for hindering the transmission of COVID-19, including, without limitation, the access/use restrictions set forth above. I agree that GH may revise its procedures at any time based on updated recommended guidance and recommendations issued by public health agencies and further agree that I will comply with GH procedures.
